Customer: Refers to you, the individual using this site, and any person or entity on whose behalf you act. By using this service, you represent that you have the authority to bind any entity or person on whose behalf you are acting. This agreement binds you, your heirs, successors, and assigns.
The purpose of this service is to bridge the gap between DIY furnace diagnosis/repair and the cost of in-person visits by trained technicians. Customers can consult directly with trained and experienced furnace repair professionals for advice and guidance. This service aims to:
Resolve the Customer’s furnace issues or reduce the number of service calls by identifying necessary parts beforehand.
Provide advice only and does not include repairing, remodeling, altering, converting, or modernizing any building.
This service is intended solely for personal, private use and not for any commercial purposes.
Customer agrees to pay the fees associated with the services provided. Payment will be processed using the payment information provided. Specific fee details will be outlined separately.
In the event of an emergency, such as fire, smoke, the smell of natural gas, or an alarm (e.g., carbon monoxide alarm), you must:
Leave the premises immediately.
Contact the appropriate emergency services and licensed professionals trained to handle such situations.
Customers agree to:
Exercise reasonable caution and ask for clarification if unsure about any advice provided.
Avoid unsafe actions, such as modifying or altering gas lines.
Customers acknowledge the risks associated with natural gas, oil-burning furnaces, and electricity, including fire, explosion, and electrocution. Always follow the furnace’s user manual.
The Company provides advice only and does not inspect or perform any work in person.
The Company expressly disclaims all warranties, express or implied, relating to any work performed based on its recommendations.
If uncomfortable or uncertain about the advice provided, Customers should seek professional services.
Liability Limitations:
The Company is not liable for any special, incidental, indirect, or consequential damages, including loss of use, profits, or data.
In the event the Company is found liable, damages will be limited to the cost of the services and the actual fair market depreciated value of the furnace.
This agreement does not waive liability for intentional, reckless, or grossly negligent conduct by the Company.
Advice and recommendations are intended solely for the Customer and the immediate future.
The Company assumes no liability for third-party use or reliance.
Customers understand that codes, standards, and technologies may change, and each situation is unique.
Customers agree to indemnify and hold harmless the Company, its officers, directors, employees, agents, suppliers, licensees, and licensors from any claims, damages, or liabilities arising from:
Use of the service.
Violations of this agreement or any third-party rights.
The Company may provide referrals to other service professionals or parts providers. These referrals:
Are suggestions only.
Do not constitute endorsements, representations, or warranties regarding the quality of goods or services provided by third parties.
If any part of this agreement is deemed unenforceable, it will be stricken, and the remainder will remain enforceable.
This agreement is governed by the laws of the State of Minnesota. Any action related to this agreement or services provided by the Company must be brought in the applicable court in Minnesota, nearest to Duluth, St. Louis County.
